Geng is a post-90 s student who was originally a college student. But as soon as she was a sophomore, she dropped out of school and opened an online shop at home, specializing in selling counterfeit luxury goods. At first, Geng opened a store for sale through a more mature online e-commerce platform. However, due to the poor quality of goods, many goods can see quality problems at a glance, so they have never been able to spend money.
In 2016, in order to find a better source of goods, she personally went to Guangzhou and found two manufacturers specializing in luxury goods counterfeiting. Manufacturers directly provide counterfeit luxury goods such as Chanel, Dior and LV, shoes and accessories to Geng, and the purchase price ranges from 100 yuan to 3,000 yuan.
After getting the goods, Geng sells them through two micro-stores under her name. Generally, she only increases the price of low-priced goods by tens of yuan, while the price of high-priced goods will increase by hundreds of yuan, but the total price is still far lower than the genuine price.
In 2018, the turnover of an online store in Geng reached more than 6 million yuan, but she said that about 1 million yuan of it came from the amount of bills, and the actual sales were about 5 million yuan. In the past two years, the profit rate of its stores is about 30%, with a profit of more than one million yuan.
After investigation, the police controlled it at Zou’s residence. The rented house was also used by her as a "warehouse". The price of counterfeit luxury goods seized in the house alone reached 3.15 million yuan, and it was appraised by various companies and appraisal institutions, except for a Cartier necklace for Geng’s own use, the rest of the goods were not genuine.
Geng said that more than half of the inventory at home was defective when it was first purchased, and it was put at home because the mother was not willing to throw it away. Not all the sales of its stores come from fakes. "There are quite a few things in my store that are not related to brands, such as some T-shirts and pants, which can account for about four fifths."
The trial pleaded guilty that the buyer also knew it was a fake.
The public prosecutor believes that Geng knows that it is a commodity with a counterfeit registered trademark and sells it. He has been in business for two years, and the sales amount has reached 5.91 million yuan, which is huge. His behavior has violated the criminal law and should be investigated for criminal responsibility for selling goods with counterfeit registered trademarks.
Today, the case was heard in Mentougou court. At 10 am, Geng was brought to court by the bailiff. But there was no tension on her face, even a smile. Geng expressed his recognition of the accusation of the public prosecution agency and voluntarily pleaded guilty.
"I usually see that these fakes are also sold on the street, so I don’t think much." Geng never thought that this kind of behavior might be suspected of committing a crime. She said that she was only trying to make money to support her family. Because the price of goods is much cheaper than that of counters, she thinks that buyers also know that these goods are not genuine, so there is no fraud and deception, and the quality of their goods is guaranteed, otherwise the store will not operate for more than two years. "We all reach a consensus."
However, in Geng’s shop, many goods descriptions have promises of "anti-counterfeiting", "accepting inspection" and "original mechanical movement". Geng said that some raw materials of the goods were authorized by the manufacturers, such as leather materials authorized by the corresponding manufacturers, but the final products were not authorized by the brand. For such a purchase channel, Geng frankly admitted that it was irregular, and he also recognized that the goods sold were fakes.
The prosecution suggested that the sentence should be three to five years.
Geng’s defender suggested that there is a big gap between the actual selling price of goods in an online shop and the genuine price, so it is not appropriate to identify and identify them according to the genuine price.
However, the prosecutor said that according to the judicial interpretation of the two courts, if the sales price can be found out in criminal cases of intellectual property infringement, it should be determined according to the actual sales price. However, some of the goods seized in this case have not been put on the shelves for sale, so they should be calculated at the market price, and the value of unsold defective products has been deducted when calculating the crime amount. Therefore, it is appropriate for the appraisal agency to determine that Geng’s sales amount involved is 5.91 million yuan.
"You want to be self-reliant and hard-working, and your starting point is very good, but selling counterfeit goods not only infringes on the interests of related companies, but also destroys the market order." The public prosecution agency believes that the goods sold by Geng are clearly printed with trademark brands, and they are aware of the nature of the behavior. Based on the overall situation of the case, it is recommended that the court sentence Geng to 3 to 5 years in prison and impose a fine.
